These Terms of Service (“Terms”) apply to gutter cleaning services (“Services”) provided by Simpler Cleaning (“Provider,” “we,” “us,” or “our”) to you (“Client,” “you,” or “your”).
By booking, paying for, or accepting our gutter cleaning Services (including via our online calendar, quote, estimate, or agreement), you agree to these Terms. If you do not agree, please do not proceed.
1. Services
We will clean your gutters as described in your quote, estimate, or booking confirmation (incorporated by reference). This typically includes:
- Removal and proper disposal of leaves, debris, dirt, and blockages from gutters and downspouts.
- Clearing downspouts to the extent accessible (e.g., from ground level or roof access).
- Basic inspection for visible issues (reported to you if noted).
- Cleanup of debris from the work area and property grounds.
Services are provided on a one-time or as-quoted basis. We aim for thorough removal but cannot guarantee 100% elimination of all embedded or inaccessible debris (e.g., shingle grit, small inorganic items).
2. Scheduling and Access
- We will schedule on a mutually agreed date with reasonable notice.
- You must provide safe, clear access to the property (including roof/gutter areas if needed), water/electrical sources if required, and remove/secure pets, vehicles, or obstacles.
- Inform us ahead of time about hazards (e.g., wasp nests, damaged sections, standing water, or buried utilities).
3. Payment
- Pricing is as shown in your quote/booking (e.g., total amount at scheduling).
- A deposit may be required to hold your appointment.
- Balance is due upon completion (or as specified), via accepted methods.
- Late payments may incur fees (e.g., 1.5% per month or a flat charge).
4. Client Responsibilities
- You confirm you are the property owner or authorized to contract for these Services.
- Keep people/pets away from work areas during and immediately after service for safety.
5. Limitations of Liability and Disclaimers
We perform Services professionally but are not liable for:
- Pre-existing damage to gutters, downspouts, roof, fascia, soffit, or property.
- Issues from hidden defects, improper prior installation, roof leaks, or normal wear/tear.
- Water intrusion, interior damage, or overflows unless directly caused by our gross negligence.
- Future clogs from ongoing leaves, trees, or weather (no long-term guarantee unless separately stated).
- Minor cosmetic marks from standard tools/ladders.
Our total liability is limited to the amount you paid for the Services. We disclaim all other warranties (express or implied).
Limited Guarantee (if offered): Some jobs include a short no-clog guarantee (e.g., 7–30 days) for re-cleaning if overflow occurs due to missed debris—subject to inspection and not covering new accumulation or unrelated issues.
6. Cancellation and Rescheduling
- Cancel/reschedule with at least 48 hours’ notice for full refund (minus any costs incurred).
- Short-notice changes may forfeit deposit.
- We may cancel/reschedule for unsafe conditions (e.g., weather, access problems) without penalty and will rebook at no extra charge.
7. Indemnification
You agree to hold us harmless from claims arising from your failure to provide access, pre-existing conditions, or your negligence.
8. Entire Agreement
These Terms (plus your quote/booking details) are the full agreement. Changes must be written and signed.
9. Governing Law
Governed by the laws of Texas.
